1. Agreement to Terms
By accessing or using Butte Front Desk services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Service Description
Butte Front Desk provides AI-powered receptionist services including:
- Answering and routing phone calls
- Scheduling appointments
- Qualifying leads
- Sending call summaries and transcripts
- Basic customer service inquiries
3. Subscription and Payment
3.1 Pricing
Services are billed monthly in advance. Current pricing is available on our website. We reserve the right to change pricing with 30 days notice.
3.2 Cancellation
You may cancel your subscription at any time with 30 days written notice. No refunds for partial months.
3.3 Overages
If you exceed your plan's included minutes, additional usage is billed at $0.12/minute or you may upgrade to a higher tier.
4. Service Level Agreement
- 99.9% uptime guarantee for core services
- 48-hour setup for new accounts
- Support response within 24 hours
- Emergency support available for Enterprise clients
5. Acceptable Use
You agree not to use the service for:
- Illegal activities or fraud
- Harassment or abusive calls
- Activities violating HIPAA (for non-compliant accounts)
- Excessive calls disrupting service for others
6. Data and Privacy
We handle your data in accordance with our Privacy Policy. By using our service, you consent to data processing as described therein.
6.1 HIPAA Compliance
For medical/dental clients, we maintain HIPAA compliance through Business Associate Agreements. You must notify us if your use involves PHI.
7. Intellectual Property
All AI responses, scripts, and custom configurations created for your account remain your property. Our underlying technology, platform, and brand remain our property.
8. Limitation of Liability
Butte Front Desk is not liable for:
- Lost business opportunities due to missed calls
- Misunderstandings or errors in AI responses
- Service interruptions beyond our control
- Indirect, incidental, or consequential damages
Our maximum liability is limited to fees paid in the 12 months preceding any claim.
9. Indemnification
You agree to indemnify and hold harmless Butte Front Desk from any claims arising from your use of the service or violation of these terms.
10. Termination
We may terminate or suspend service immediately for:
- Non-payment
- Violation of these terms
- Fraudulent or illegal activity
11. Governing Law
These terms are governed by California law. Any disputes will be resolved in Butte County, California courts.
12. Changes to Terms
We may update these terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes.
